Definitions
:
NIL Activity: An activity that involves the use of an individual’s name, image and likeness for commercial or promotional purposes.
 
Compensation: Remuneration or payment in any form received for work or services performed, including cash, credit, cryptocurrency, product, or other benefit. 
 
Pay for Play: Compensation provided by an institution (including staff members, representatives of athletics interests, etc) to a student-athlete in any form for their performance in a sport in which the student-athlete participates at an NCAA Division I institution.
 
Professional Service Provider: A professional service provider is an individual who provides third-party services to a prospective or current student-athlete. It includes, but is not limited to, an agent, tax advisor, marketing consultant, attorney, brand management company or anyone who is employed or associated with such persons.
 
Prospective Student-Athlete: A prospective student-athlete is a student who has started classes for the ninth grade.
 
Agent: An agent is any individual who, directly or indirectly: (a) Represents or attempts to represent an individual for the purpose of marketing the individual's athletics ability or reputation for financial gain; or (b) Seeks to obtain any type of financial gain or benefit from securing a prospective student-athlete's enrollment at an educational institution or from a student-athlete's potential earnings as a professional athlete.
 
Representative of Athletics Interests: A "representative of the institution's athletics interests" is an individual, independent agency, corporate entity (e.g., apparel or equipment manufacturer) or other organization who is known (or who should have been known) by a member of the institution's executive or athletics administration to: 
(a) Have participated in or to be a member of an agency or organization promoting the institution's intercollegiate athletics program; 
(b) Have made financial contributions to the athletics department or to an athletics booster organization of that institution;
(c) Be assisting or to have been requested (by the athletics department staff) to assist in the recruitment of prospective student-athletes; 
(d) Be assisting or to have assisted in providing benefits to enrolled student-athletes or their family members; or 
(e) Have been involved otherwise in promoting the institution's athletics program.
