Compliance for Student-Athletes

Employment

Summer Camps/Clinics: Enrolled student-athletes are permitted to be employed by summer camps and clinics, but they are required to follow these guidelines:

1. Compensation must be at the going rate for camp counselors of like teaching ability and camp/clinic experience. Student-athletes cannot be paid on the basis of athletic reputation or fame.

2. A student-athlete who only lectures or demonstrates at the camp/clinic may not be compensated for his/her appearance.

Some regulations regarding student-athletes and employment:

1. Student-athletes may only be paid for actual work they have performed.

2. Student-athletes may not be paid by the employer for the value they may bring to their employer because of their athletic reputation or fame.

3. Student-athletes may not be paid for teaching or coaching sport skills or techniques in his or her sport on a fee-for-lesson basis. However, such employment is permitted prior to enrolling at a collegiate institution.

4. Student-athletes may be employed on commission basis if the following conditions are met:

a. The cost of any preliminary training must be paid for by the student-athlete. (i.e. the cost cannot be paid by the institution or a booster)

b. The personnel employed by the company must consist of both student-athletes and non-athletes.

c. The employment of student-athletes does not result in the company's use of the athletics reputation of any student-athlete's employed by the company.

d. The company must be able to document that employees who are non-athletes are receiving sales commissions at a rate generally equal to that of student-athletes employed by the company.

Earnings from a student-athlete's on- or off-campus employment that occurs at any time is exempt and is not counted in determining a student-athlete's full grant-in-aid or in the institution's financial aid limitations, provided:

a. The student-athlete's compensation does not include any remuneration for the value or utility that the student-athlete may have for the employer because of the publicity, reputation, fame or personal following that he or she has obtained because of their athletics ability;

b. The student-athlete is compensated only for work actually performed; and

c. The student-athlete is compensated at a rate commensurate with the going rate in that locality for similar services.

Permission to Contact Request Policy and Description of Benefits:

A student-athlete may speak to another institution regarding a possible transfer, provided they have received permission to contact. Permission to contact must be granted per the policy outlined in Section 5 of the Student-Athlete Handbook.

If a student-athlete does request permission to contact, the below policy will be used to assess the students use of department benefits provided to a student-athlete.

Student-athlete benefits include:

  • Use of the strength and conditioning facilities and staff;
  • Use of the sports medicine facilities and staff. This staff includes trainers and sports physicians;
  • Use of the academic advising facilities and services. This includes the use of the academic advising office as a study space, all computer usage and printing services in the academic advising office, advising or tutoring help offered by academic advising, schedule placement and assistance, and text book ordering; and
  • Access to any additional nutritional supplements, snacks, or meals incidental to participation.

If a student-athlete has requested permission to contact, but will remain on the institution's team for the remainder of the season/year, they will be permitted to continue to use the benefits outlined above.

If a student-athlete has requested permission to contact and from that date forward, will no longer remain on the institution's roster, they will no longer be permitted to continue to use the benefits outlined above. Notice of a student-athletes removal from the team will be communicated to the appropriate department parties to ensure that such benefits cease.
